Question 890: To ask the Minister for Health his view on whether it is good practice for general practitioners to be renting or leasing buildings to pharmacies in the neighbourhood of their practice and more particularly on the same campus; his policy towards same; and if he will make a statement on the matter. Section 63 of the Pharmacy Act 2007 provides that it is professional misconduct for a pharmacist or pharmacy owner to have beneficial interest in a medical practice, and for a medical practitioner to have a beneficial interest in a pharmacy.

The Act does not prohibit adjacent location of a medical practice or pharmacy, as long as there is no shared public access and no inappropriate financial arrangement, i.e. where there is a financial or other benefit in excess of what might be considered a normal tenancy relationship.
