Question 736: To ask the Minister for Agriculture, Food and the Marine if he will review a case (details supplied) in which a significant penalty was imposed on a single farm payment as a consequence of significant on-farm investment which was completed in order to address the issue of farm yard pollution; and if he will make a statement on the matter. The person named was the subject of a Nitrates inspection by the Integrated Controls Division of my Department acting on behalf of the Department of the Environment, Heritage and Local Government on the 2nd of March 2011. This inspection uncovered discrepancies that were deemed to be intentional and a penalty of 20% was recorded for breaches of the Nitrates regulations. The person named was informed of this decision on the 14th of March and of his right to seek a review. He was also informed of his right to appeal the outcome of any review to the Independent Agriculture Appeals office. To date there is no record of such a request.
Following your request I will arrange for a review to be carried out in this case. The person named will be notified of the outcome as soon as it is available.
