Question 413: To ask the Minister for Agriculture, Food and the Marine if he will consider a grant application under force majeure in respect of a person (details supplied) in County Limerick; and if he will make a statement on the matter. [32883/11]

Under the terms of the current EU provisions which govern my Department's on-farm investment schemes, recognition of the principle of force majeure is strictly limited to actual beneficiaries under the schemes concerned and, even in those cases, the options are restricted. I am not, therefore, in a position to consider an application of the principle of force majeure in relation to failure to make an application under an on-farm investment scheme. The possibility of re-opening the scheme will be decided shortly in the context of the comprehensive review of expenditure which has been carried out in my Department and in the process of finalising the 2012 Estimate.
