Question 562: To ask the Minister for Transport, Tourism and Sport the regulations in place for private car parks, in terms of insurance, rate charged, supervision, taxes and so on; and the way in which they are policed. [31882/11]

Under road traffic legislation, I have powers to make regulations relating to parking on public roads and in local authority car parks. This legislation applies to public roads and does not apply to private car parks.

At present, the position is that private car parks, privately operated and on private land, are regarded as private businesses engaging in contractual relationships with their customers. The terms under which they operate and any insurance requirements are provided for in the Companies Acts and other legislation coming within the remit of my colleague the Minister for Jobs, Enterprise and Innovation. Taxation matters are dealt with by the Revenue Commissioners.
