Question 144: To ask the Minister for Agriculture, Fisheries and Food the reason a person (details supplied) in County Cork has had a deduction from their single farm payment; if he will review this case and refund the withheld money in view of the fact that they are now compliant with environmental regulations and have recently built a slurry holding tank; and if he will make a statement on the matter. The person named was the subject of a Nitrates inspection by the Integrated Controls Division of my Department acting on behalf of the Department of the Environment, Community and Local Government on the 2nd of March 2011. This inspection uncovered discrepancies that were deemed to be intentional and a penalty of 20% was recorded against the 2011 Direct Payment for the person named.

The person named was informed of this decision on the 6th of April 2011 and of his right to seek a review. He was also informed of his right to appeal the outcome of any review to the Independent Agriculture Appeals office. To date, no request for a review has been submitted, however, your question will now be taken as a request for review which will now be carried out. As part of this review any new facts or evidence will have to be supplemented with supporting documentation.
