Question 123: To ask the Minister for Justice and Equality further to Parliamentary Questions Nos. 280 and 334, the sanctions that have been applied in the 165 applications for the enforcement of court orders granted in 2010 and the 202 applications for the enforcement of court orders granted in 2009; the reason these applications were not referred to in the Court Services Report 2010; and if he will make a statement on the matter. The statistics supplied in response to the previous Parliamentary Questions referred to by the Deputy related to cases taken under Section 5 (2) of the Courts (No. 2) Act 1986 arising from alleged breaches of Sections 7 or 11 of the Guardianship of Infants Act 1964. Under the provisions of the Courts Service Act 1998, the management and administration of the courts including responsibility for maintaining and publishing court statistics is a function of the Courts Service.

However, in order to be of assistance to the Deputy, I have had enquiries made and the Courts Service has informed me that the further detailed information sought by the Deputy is not currently collected and could only be retrieved by way of a manual examination of each individual Family Law court record in those courts where an Order was granted. As I am sure the Deputy will appreciate, this would require the expenditure of a disproportionate amount of staff time and resources and it is therefore not possible to provide the level of detail sought.

I am informed it is not possible to include all statistics in the Annual Report. However, the Courts Service has indicated that consideration will be given to including the information previously supplied in response to Parliamentary Question No. 280 in future Annual Reports.

Minister Shatter claims that a detailed response to the question "would require the expenditure of a disproportionate amount of staff time and resources and it is therefore not possible to provide the level of detail sought".

Is he now involved in a cover-up as he is aware that mothers who thwart Court Ordered access between fathers and their children are not sanctioned?

Minister Shatter recently said that "My personal experience prior to becoming Minister, as a lawyer dealing professionally with family law matters, was that one of the big difficulties in this area is that many fathers do not take responsibility for their children. Indeed, many of them do not seek to form and cement relationships with their children, or to involve themselves in their children's lives".

Minister Shatter is not only aware of the bias fathers face in the Secret Family Law Courts, Courts that fail to enforce their own orders, but is also quite obviously biased against fathers himself.
