Question 235: To ask the Minister for Justice and Equality the progress made to date in the determination of residency and/or citizenship entitlement in the case of a person (details supplied) in Dublin 15; when he expects matters to be concluded; and if he will make a statement on the matter. The person concerned is the subject of a Deportation Order, signed on 9 July 2008, following a comprehensive and thorough examination of their asylum claim, and a detailed examination of the representations submitted by the applicant for consideration under Section 3 of the Immigration Act 1999 (as amended). The effect of the Deportation Order is that the person concerned must leave the State and remain thereafter out of the State. The enforcement of the Deportation Order is an operational matter for the Garda National Immigration Bureau. Officials in the Citizenship Division of the Irish Naturalisation and Immigration Service (INIS) inform me that there is no record of an application for a certificate of naturalisation from the person referred to by the Deputy.

I should remind the Deputy that queries in relation to the status of individual Immigration cases may be made direct to INIS by Email using the Oireachtas Mail facility which has been specifically established for this purpose. The service enables up-to-date information on such cases to be obtained without the need to seek this information through the more administratively expensive Parliamentary Questions process.

The person concerned has been granted Leave to Remain in the State for the period to 5th September, 2011. This decision was conveyed in writing to the person concerned by letter dated 6th October, 2010. The person concerned is required to apply in writing for the renewal of this permission. My Department's records show no evidence of such a renewal application having been made to date. As a result, it is recommended that the person concerned should do so in the coming weeks.
