Question 196: To ask the Minister for Communications, Energy and Natural Resources if he has the responsibility to ensure that all agencies and semi-State companies under the aegis of his Department adhere to the public procurement procedures laid down by the Department of Finance; the systems in place to investigate any concerns raised by the public in relation to adherence to these procedures; the general systems in place in his Department to have oversight of this responsibility; and if he will make a statement on the matter. The procurement activities of the bodies and agencies operating under the aegis of my Department are day-to-day operational matters for those bodies and agencies. It is the responsibility of the board of each agency and company to satisfy itself that the requirements for public procurement are adhered to. Each body and agency submits an Annual Report to my Department under the Code of Practice for the Corporate Governance of State-sponsored Bodies of which compliance with procurement requirements is an integral component. My Department keeps all of the bodies and agencies operating under its aegis fully up to date with the Department of Finance's procurement guidelines and their obligations in that regard. As the Deputy will be aware, public bodies are required to comply with EU public procurement rules when procuring goods and services.
