Question 57: To ask the Minister for Communications, Energy and Natural Resources the reason a draft net licence for 2011 was refused in respect of a person (details supplied) in County Kerry; if he will explain the workings of Article 6 of Order 2011, Statutory Instrument No.123, 2011; and if he will make a statement on the matter. As indicated in my reply to Question No. 305 of 17 May 2011, the application for a draft net salmon licence by the individual concerned was unsuccessful. As the Deputy is aware Article 6 of the Control of Fishing for Salmon Order 2011 (SI 123 of 2011) sets out the order of priority under which licence allocations are decided. There were only three commercial licences available in the Kerry Fishery District. In accordance with Article 6 of the Control Order, three other applicants who had higher priority status were granted these commercial fishing licences.

As the Deputy may be aware there is a statutory public consultation process currently underway in relation to the commercial fishery in Castlemaine Harbour. In the event of the re-opening of the commercial fishery in Castlemaine Harbour, it will be necessary to revise the Control of Fishing for Salmon Order to set out the order of priority in which additional licences would be granted in the Kerry fishery district. I intend to make such an order in the coming weeks.
