Question 116: To ask the Minister for Justice and Equality his plans to amend section 23(1) of the Non-Fatal Offences Against the Person Act 1997, to reflect legal guardians acting jointly in line with section 6(1) of the Guardianship of Infants Act 1964 which states that the father and mother of an infant shall be guardians of the infant jointly, and the amendment of the Guardianship of Infants Act 1964 by section 39(3)([i]a[/i]) of the Status of Children Act 1987, which states that a blood sample may be taken from a minor, other than one to whom subsection (2) of this section relates, if the person having charge of or control over the minor consents: Provided that where more than one person has charge of or control over the minor and they disagree as to whether consent should be given, the minor shall be treated as not having consented.
