As Minister for Transport, I have responsibility for overall policy and funding in relation to the national roads programme. The construction, improvement and maintenance of individual national roads (including the provision of service areas) are matters for the National Roads Authority (NRA) under the Roads Acts 1993 to 2007 in conjunction with the local authorities concerned. Noting this I have referred the Deputy's question to the NRA for direct reply. Please advise my private office if you don't receive a reply within 10 working days.

Question 426: To ask the Minister for Transport, Tourism and Sport if he has reviewed the operation of all toll charges across the national road network in view of the recent legal disputes that have arisen regarding overcharging; and if he will make a statement on the matter. [10585/11]

As Minister for Transport, I have responsibility for overall policy and funding in relation to the national roads programme. The construction, improvement and maintenance of individual national roads are matters for the National Roads Authority (NRA) under the Roads Acts 1993 to 2007 in conjunction with local authorities concerned.

In particular, the statutory power to levy tolls on national roads, to make toll bye-laws and to enter into toll agreements with private investors in respect of national roads is vested in the NRA under Part V of the Roads Act 1993 (as amended by the Planning and Development Act 2000 and the Roads Act 2007).

Toll rates for 2011 for a number of toll schemes have been the subject of a dispute between the NRA and the relevant PPP operators concerned. Where necessary, the NRA has sought clarification through the Courts system.

Question 427: To ask the Minister for Transport, Tourism and Sport when construction contracts will be awarded to begin works on the N3 Belturbet bypass; the N4 downs grade separation; the N3 Longford bypass; the N7 Newlands Cross-N11 Arklow to Rathnew PPP and Gorey service area; the M17-18 Gort to Tuam road; and if he will make a statement on the matter.
