Question 412: To ask the Minister for Transport, Tourism and Sport if there are any requirements for road works affecting cycle lanes to be finished to a higher standard than would otherwise be the case, in view of the fact that cycle lanes are paid for out of the public purse, but can be left impassible after work carried out by private companies; and if he will make a statement on the matter. The improvement and maintenance of regional and local roads is the statutory responsibility of each local authority, in accordance with the provisions of Section 13 of the Roads Act 1993. Works on those roads are funded from local authorities own resources and are supplemented by State road grants. The initial selection and prioritisation of projects to be funded is also a matter for the local authority.

Local authorities have been provided with a number of best practice documents and are required to apply these guidelines when carrying out works on regional and local roads.

Private companies require the prior written consent of the relevant road authority to carry out road works. It is the responsibility of the local authority to ensure that all works carried out by private companies are of a satisfactory standard.

As Minister for Transport, I have responsibility for overall policy and funding in relation to the national roads programme. The construction, improvement and maintenance of individual national roads is a matter for the National Roads Authority under the Roads Acts 1993 to 2007 in conjunction with the local authorities concerned. Noting this, I have referred the Deputy's question to the NRA for direct reply in relation to his concerns. Please advise my private office if you don't receive a reply within 10 working days.

Question 414: To ask the Minister for Transport, Tourism and Sport his policy in regard to the introduction of further road tolling; if it is intended to toll the Jack Lynch Tunnel and or the Mallow Road, Cork; and if he will make a statement on the matter. [10286/11]

As Minister for Transport, I have responsibility for overall policy and funding in relation to the national roads programme. The construction, improvement and maintenance of individual national roads are matters for the National Roads Authority (NRA) under the Roads Acts 1993 to 2007 in conjunction with the local authorities concerned. In addition, the statutory power to levy tolls on national roads, to make toll bye-laws and to enter into toll agreements with private investors in respect of national roads is vested in the NRA under Part V of the Roads Act 1993 (as amended by the Planning and Development Act 2000 and the Roads Act 2007). The "National Roads Traffic Management Study" published recently together with other work being undertaken by the NRA will help inform consideration of future traffic management measures, including tolling. The issues involved will need to be considered carefully before decisions are made on future tolling strategy.
