Question 94: To ask the Minister for Social Protection the reason persons (details supplied) in County Kerry were refused mortgage interest relief even though one of the persons works for less than 30 hours a week; and if she will make a statement on the matter. [9918/11]

Under the supplementary welfare allowance scheme, mortgage interest supplement is not payable where one of a couple in a household is engaged in full-time employment. The Health Service Executive (HSE) has advised that in January 2011 it refused a mortgage interest supplement in this case on the grounds that the spouse of the person concerned was engaged in full time employment.

The HSE has further advised that this decision was subsequently appealed to and upheld by the HSE's designated Appeals Officer.
