Question 500: To ask the Minister for Agriculture, Fisheries and Food when a reactor payment will issue as approved by the Circuit Court in February 2011 in respect of a person (details supplied); and if he will make a statement on the matter. [9197/11]

The On-Farm Market Valuation scheme provides for the payment of compensation for animals removed as reactors under the TB and Brucellosis Eradication Programme. Letters outlining the decision to withhold payments of compensation for animals removed from the holding concerned were issued to the herdowner in question in 2009.

I wish to point out that the matter of compensation concerning this herdowner was not ruled on by the court case in question. Payment of compensation is a matter for my Department and there is a formal appeal process in place for farmers regarding decisions on compensation. I understand that information has recently been received to enable an appeal of the 2009 decision to proceed. The appeal is currently being examined as part of the established appeal procedure provided for under the terms of the scheme and it is expected that a decision on the matter will be taken in the coming weeks.
