Question 321: To ask the Minister for Social Protection when a domiciliary care allowance will be granted in respect of a person (details supplied) in County Kilkenny; and if she will make a statement on the matter. [9476/11]

An application for domiciliary care allowance was received on the 11th June 2010. This application was referred to one of the Department's Medical Assessors who found that the child was not medically eligible for the allowance. A letter issued on the 12th August 2010 where the customer was advised of the decision. The person concerned subsequently lodged an appeal against this decision and she was informed by the Social Welfare Appeals Office on the 11th February 2011 that the appeal had not been allowed.

The decision/appeal process for this application is now complete. All the information available at that time was provided to the appeals officer before the appeal was considered.

Question 322: To ask the Minister for Social Protection the position regarding a non-contributory pension in respect of a person (details supplied) in County Wicklow; if this will be dealt with as a matter of urgency; and if she will make a statement on the matter. [9503/11]

The Social Welfare Appeals Office has advised me that, following receipt of the relevant Departmental papers including comments on the grounds of appeal, the appeal from the person concerned was referred to an Appeals Officer for consideration. The Appeals Officer has referred the case to the Deciding Officer for clarification on certain matters. Every effort will be made to have this appeal dealt with as quickly as possible.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
