Question 107: To ask the Minister for the Environment, Heritage and Local Government if he has sought or received a guarantee from the European Commission that his proposed model for domestic water charges which reportedly involves a free portion for each household is not in breach of the full cost recovery principle of Article 9 of the Water Services Directive considering that only Ireland's established practice is exempt from that principle; if he has sought legal advice on the matter and if so, the nature of the advice received. Work is being advanced in the Department on the preparation of draft legislation which will provide, inter alia, for the introduction of domestic water charges. The advice of the Attorney General will be obtained on all aspects of the draft legislation before it is finalised.
