Question 400: To ask the Minister for the Environment, Heritage and Local Government if the 52 acres of Dublin Bay are now safe from any further infills. [3385/11]

An Bord Pleanála recently refused a proposal by Dublin Port to expand the port by infilling an area of Dublin Bay which is within a Special Protection Area.

The Planning and Development Acts 2000 to 2010 provide the primary framework in which development proposals are considered by local planning authorities, and An Bord Pleanála in the case of an appeal. Assessment of the potential impact of a proposed development on sites designated for protection under the Habitats Directive or Birds Directive must also be undertaken in accordance with the requirements of the Directives themselves, as transposed into Irish law.

Any proposal for development must be considered on its own merits.
