Question 338: To ask the Minister for Social Protection the position regarding an application for invalidity pension and illness benefit in respect of a person (details supplied) in County Longford; and if he will make a statement on the matter. [3312/11]

Invalidity pension is a payment for people who are permanently incapable of work because of illness or incapacity and who satisfy the contribution conditions. On 13 January 2011, an application for invalidity pension was received from the person concerned. A diagnostic report issued on 20 January 2011 to the customer concerned to be completed by her General Practitioner. When this is completed and returned, it will be forwarded to the Chief Medical Advisor for an opinion on her medical suitability for invalidity pension.

Question 339: To ask the Minister for Social Protection the reason a person (details supplied) with five children, who has been receiving family income supplement for over two years and whose spouse has been unemployed for over three years, is not entitled to back to school allowance in respect of the relevant children; and if he will make a statement on the matter. The back to school clothing and footwear allowance (BSCFA) scheme is administered by the Health Service Executive (HSE) on behalf of the Department. A person may qualify for BSCFA if he or she is in receipt of a social welfare or health service executive payment, is participating in an approved employment scheme or attending a recognised education or training course, and has household income at or below certain specified levels. The HSE has advised that the family concerned were refused BSCFA as their income was above the limit allowable to qualify for payment and they were advised of their right to have the decision reviewed. The person in question sought this review but the decision to refuse the payment was upheld.
