The Social Welfare Appeals Office has advised me that an appeal by the person concerned has been registered in that office. It is a statutory requirement of the appeals process that the relevant Departmental papers and comments by the Social Welfare Services on the grounds of appeal be sought. When received, the appeal in question will be referred to an Appeals Officer for consideration.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.

The Social Welfare Appeals Office has advised me that an appeal by the person concerned has not been received by that office. A form for the opening of an appeal has been forwarded to the person concerned and requesting him to state the grounds for his appeal. On receipt of his reply the appeal will be opened and processed in the normal manner.

On 24 August 2010 the person concerned was refused carer's allowance on the grounds that full time care and attention is not required in this case. She was notified of this decision, the reason for it and of her right to appeal to the Social Welfare Appeals Office. She has appealed this decision and an appeal has been opened in this case. On 14 January 2011 her carer's allowance file was submitted to the Social Welfare Appeals Office. The Social Welfare Appeals Office will be in contact with her directly regarding this appeal.
