Question 681: To ask the Minister for Social Protection if he will use his discretionary powers to refer back to the appeals officer for reconsideration the appeal file in the case of a person (details supplied) in County Kildare with particular reference to the actual specifics of the case; and if he will make a statement on the matter. Further to my response to PQ 26865/10 on 22 June 2010 and PQ 41415/10 on 9 November 2010, I am advised by the Social Welfare Appeals Office that there is no update to the information given previously. The person concerned has not supplied any new evidence or new facts since the previous responses.

The Social Welfare Appeals Office functions independently of the Minister for Social Protection and of the Department and is responsible for determining appeals against decisions on social welfare entitlements.
