The person concerned claimed jobseeker's benefit from 15th June 2010. On the 24th June 2010 a form was issued to her requesting details of her holiday pay entitlements. A decision will be made on her claim when the details requested have been received.

Question 215: To ask the Minister for Social Protection when child benefit will be awarded in respect of a person (details supplied) in County Westmeath; and if he will make a statement on the matter. [28912/10]

A claim for Child Benefit was received from the person concerned in June 2008, in respect of three children, and a further claim from his partner in September 2008. Further information was requested in relation to the Habitual Residency Condition. The requested information was not supplied and the claim consequently lapsed. A new application form was issued automatically on 9th November 2009, following the birth of a fourth child, but this has not been returned to date.

The person concerned has been furnished with a copy of their full social insurance contribution record. This is a full representation of customer social insurance contribution record as held by the Department. If the person concerned feels there are gaps or omission in his record he should contact the Departments Records section.

Question 217: To ask the Minister for Social Protection if a person (details supplied) in County Kildare qualifies for back to education allowance; and if he will make a statement on the matter. [28915/10]

Under the back to education allowance scheme a person eligible for the scheme can transfer entitlement to his or her qualified adult. As the person concerned is a qualified adult on her spouse's jobseeker's allowance claim she may be entitled to avail of this provision.

An application form for the back to education allowance was sent to the person concerned on 29 th June 2010 which she should complete and return to her local social welfare office so that her eligibility can be established.

The payment of child benefit was suspended in this case because the person concerned was absent from the State with her children. Child benefit forms have issued to the person concerned today on foot of the enquiry from the Deputy.

Question 219: To ask the Minister for Social Protection the reason a person (details supplied) in County Cork has had their mortgage supplement reduced; and if he will make a statement on the matter. [28928/10]

The supplementary welfare allowance scheme provides for a weekly or monthly supplement to be paid in respect of mortgage interest to any person in the State whose means are insufficient to meet their needs. The scheme is administered by the community welfare service of the Health Service Executive on behalf of the Department.

Mortgage interest supplement provides short-term income support to eligible people who are unable to meet their mortgage interest repayments in respect of a house which is their sole place of residence. The supplement assists with the interest portion of the mortgage repayments only.

The Health Service Executive has advised that the person concerned has mortgage interest repayments of €48 per week but has no entitlement under the mortgage interest supplement scheme as their income exceeds the limits. This decision was upheld on 9th April, 2010 by the HSE's designated Appeals Officer It is open to the person concerned to appeal this decision to the Social Welfare, Chief Appeals Office.

The HSE has further advised that as an exceptional measure the person in question was awarded a supplement of €20 per week.
