The Department of Transport has made one settlement with the Revenue Commissioners under Section 985B of the Taxes Consolidation Act, 1997 in the years 2005, 2006, 2007, 2008 and 2009. A payment was made in 2006 for €55,762.58 in relation to a settlement for VAT which had not been applied to a number of transactions in the period from 2004 to 2005. Subsequently, adequate systems were put in place to capture all transactions for VAT purposes.

Question 142: To ask the Minister for Transport if he will provide details of tax audits carried out by the Revenue Commissioners on his Department in the years 2005, 2006, 2007, 2008, 2009 and to date in 2010 under the headings employer issues PAYE and PRSI, value added tax, public service withholding tax and relevant contracts tax; if, in relation to the audits, he will provide an analysis of the results, including the amount of tax, interest and penalties assessed and collected; the number of audits in which incorrect operation was discovered but no assessment was entered; the number of audits in which operation was found in order; and if he will make a statement on the matter. A tax audit was carried out by the Revenue Commissioners on the Department of Transport in 2005 under the headings employer issues PAYE and PRSI, value added tax, public service withholding tax and relevant contracts tax. The audit of PAYE, PRSI, public service withholding tax and relevant contracts tax found that matters were in order.

As a result of this audit liability in respect of some VAT payments was identified. The details of the liability payments made on foot of the audit findings in respect of VAT are as follows:

Amount of tax €44,899.76

Amount of Interest €4,096.22

Amount of Penalties €6,766.60

Total Liability paid €55,762.58

The area of VAT was the only element of the audit in which a discrepancy was identified.
