Question 58: To ask the Minister for Enterprise, Trade and Innovation the number of unprompted voluntary disclosures made by his Department to the Revenue Commissioners in the years 2005, 2006, 2007, 2008, 2009 and to date in 2010 under the headings employer issues PAYE and PRSI, value added tax, public service withholding tax and relevant contracts tax; if, in relation to these unprompted voluntary disclosures, he will provide a summary of the tax, interest and penalties collected; and if he will make a statement on the matter. Question 60: To ask the Minister for Enterprise, Trade and Innovation if he will provide details of tax audits carried out by the Revenue Commissioners on his Department in the years 2005, 2006, 2007, 2008, 2009 and to date in 2010 under the headings employer issues PAYE and PRSI, value added tax, public service withholding tax and relevant contracts tax; if, in relation to the audits, he will provide an analysis of the results, including the amount of tax, interest and penalties assessed and collected; the number of audits in which incorrect operation was discovered but no assessment was entered; the number of audits in which operation was found in order; and if he will make a statement on the matter. I propose to take Questions Nos. 58 and 60 together.

My Department has no record of any voluntary disclosures having been made to the Revenue Commissioners from 2005 to date. No tax audits have been carried out by the Revenue Commissioners on my Department in that period.

Question 59: To ask the Minister for Enterprise, Trade and Innovation if he has made any settlements with the Revenue Commissioners under section 985B of the Taxes Consolidation Act, 1997 in the years 2005, 2006, 2007, 2008 and 2009; and if he will make a statement on the matter. [28990/10]

I am advised that Section 985B of the Taxes Consolidation Act, 1997, provides that the Revenue Commissioners may make arrangements with employers whereby the employers will themselves pay to the Revenue Commissioners the tax payable in respect of certain benefits provided to employees which are minor and irregular, rather than deducting the tax from the earnings of the employees and accounting for it through the PAYE system. My Department has not entered into any such arrangements with the Revenue Commissioners since 2005.
