Question 329: To ask the Minister for Justice and Law Reform if the boards of State agencies under the aegis of his Department which are required to implement the new Code of Practice for the Governance of State Bodies that have formally adapted the code at a board meeting; if they have undertaken training to ensure proper implementation of the code; the monitoring procedures they have put in place to ensure proper compliance with the code; and if he will make a statement on the matter. Question 330: To ask the Minister for Justice and Law Reform if his Department has reviewed the compliance by State bodies that come under its remit with the Code of Practice for the Governance of State Bodies; if he will name the State bodies that have not achieved full compliance; the reason for same: the action taken by his Department; the results of same; and if he will make a statement on the matter. I propose to take Questions Nos. 328 to 330, inclusive, together.

The Code of Practice for the Governance of State Bodies applies to the following Bodies under the aegis of my Department: The Courts Service The Property Registration Authority The Legal Aid Board The Private Security Authority The Office of the Data Protection Commissioner The Office of the Refugee Applications Commissioner The Refugee Appeals Tribunal The Garda Síochána Ombudsman Commission The Irish Film Classification Office

The Code has been considered by the Bodies concerned. In the case of those Bodies which are constituted with a Board (i.e. the Courts Service, the Property Registration Authority, the Legal Aid Board and the Private Security Authority), the Boards concerned have adopted the Code and I am advised that they have put in place the necessary measures to bring about compliance, as appropriate to them. These measures include the provision of training for Board members and the establishment of appropriate monitoring arrangements.

The Boards concerned have also reported to the Department on the measures being taken to bring about compliance. In the case of the other Bodies which do not have a Board structure, appropriate measures are also in place to bring about compliance. Corporate governance arrangements are overseen by the appropriate Line Divisions of my Department and by senior management at Heads of Sector meetings.
