Question 164: To ask the Minister for Justice, Equality and Law Reform if there is a system whereby a driver who was disqualified from driving can lodge a case for consideration to have the duration of disqualification reduced; and if there are criteria that would be up for consideration in such a case. The Deputy will appreciate that responsibility for licensing issues under the Road Traffic Acts is a matter for the Minister for Transport. However, I understand that Section 29 of the Road Traffic Act 1961, as amended by section 7 of the Road Traffic Act 2006, allows a person who has been disqualified for more than 2 years to apply to have the disqualification removed. In order to apply the person must have completed one half of the period of disqualification. The Court may, on application, confirm the period of disqualification or order the removal of the disqualification from a specified date such that the person will have served at least two thirds of the original period of disqualification.
