Question 159: To ask the Tánaiste and Minister for Education and Skills the reason persons (details supplied) in County Limerick were not awarded the additional three weeks redundancy entitlements following a Labour Court recommendation when 42 of their co-workers were awarded same; and if she will make a statement on the matter. In November 2004 the Department of Enterprise, Trade and Employment announced a policy change to the Job Initiative Programme that provided for contracts to be renewed for participants who wished to remain on the scheme thus removing the requirement for participants to leave. This policy change brought about an amendment to the rules regarding redundancy payments and allowed for the payment of enhanced redundancy to persons made redundant after November 2004.

I understand that the matter in question relates to persons employed under a Job Initiative Scheme who were made redundant in November 2003, prior to the rule change, and therefore they would not have an entitlement to an enhanced redundancy payment.
