Question 170: To ask the Minister for Finance if he has plans to amend the Freedom of Information Act in order that it apply to the Office of the Ombudsman in the same way as to any other body and subject to the same grounds for declining information and the same process of appeal when parties are unhappy with the outcome of a request for information. Under section 46 of the FOI Act, the Act does not apply to records relating to an investigation or examination carried out by the Ombudsman under the Ombudsman Act, 1980 other than a record that was created before the commencement of such an investigation or examination, together with any administrative records of the Office Ombudsman which are also covered by FOI. I do not have any plans to amend the Act in relation to the investigation or examination records of the Office of the Ombudsman.
