Question 166: To ask the Minister for Health and Children the EU countries that have already given effect to Commission Decision No. 2003/641/EC of 5 September 2003 on the use of colour photographs or other illustrations as health warnings on tobacco products; the reason for her delay in bringing forward regulations under the Public Health (Tobacco) (Amendment) Act 2009 in order to give effect to the Commission Decision; her plans to introduce the regulations; when it is envisaged that they will take effect; and if she will make a statement on the matter. Section 6 of the Public Health (Tobacco) (Amendment) Act, 2009 provides for regulations to facilitate the introduction of the combined text and photo warnings on tobacco products and the regulations are currently being drafted. The date for the introduction of the new warnings will be determined following consultation with the relevant stakeholders. To date, Belgium and the United Kingdom have given effect to this non binding Commission Decision.
