Question 186: To ask the Minister for Social Protection further to Parliamentary Question No. 210 of 12 may 2010, if correspondence (details supplied) from the Health Service Executive was or will be taken into consideration in relation to an application for child benefit in respect of a person in County Kildare; and if he will make a statement on the matter. The correspondence referred to from the Health Service Executive (HSE) was not taken into consideration in relation to the application for Child Benefit from the person concerned. Habitual residence condition decisions made by any Deciding Officer are based on the officer him/herself being satisfied that the HRC conditions are met.
As outlined in reply to PQ, Reference No. 17546.10, Child Benefit applications were received in August 2007 and August 2008 from the person concerned and both were disallowed on the grounds that she did not satisfy the HRC. She was notified of the decisions in writing and advised of the right to appeal. No appeals were received.
