Question 34: To ask the Minister for Justice, Equality and Law Reform if his attention has been drawn to a recent newspaper report (details supplied) which reported that estate agents were claiming that they could use the gardaí to illegally access Garda intelligence systems to conduct background checks on potential tenants; if any investigation is planned into these reports; and if he will make a statement on the matter. I am informed that the matters raised in the newspaper report referred to by the Deputy have been investigated by the Office of the Data Protection Commissioner, which has no plans to investigate them further.
An Garda Síochána has in place a code of practice for data protection. The code, which was drawn up in close consultation with the Office of the Data Protection Commissioner and approved by that Office, contains safeguards to prevent the improper disclosure of data.
