Question 128: To ask the Tánaiste and Minister for Enterprise, Trade and Employment with regard to a residential or owners management company which is struck off the companies list, the person who has ownership of any money held by that company in the form of a sinking fund and the person who owns any other assets; and if she will make a statement on the matter. The State Property Acts make provision, among other things for the devolution of property of dissolved and struck off companies. This legislation is the responsibility of the Minister for Finance.

The Minister for Justice, Equality and Law Reform is currently at Committee Stage in the Seanad with the Multi-Unit Developments Bill 2009. That Bill provides for changes in the law relating to the ownership and management of the common areas of multi-unit developments, the fair, efficient and effective management of bodies responsible for the management of such common areas and related matters, including, sinking funds, service charges, annual charges, dispute resolution, mediation and the restoration to the Companies Register following strike off.
