Question 202: To ask the Minister for Justice, Equality and Law Reform if any banking institution, pension fund or the National Treasury Management Agency has over the past 18 months made representations to him in relation to the potential impact that a retrospective end to upward only rent reviews would have on commercial property prices; if so, if he will publish those representations, or the minutes of those representations. The only correspondence received by my Department which falls within the scope of the Deputy's question is a letter I received from the Irish Association of Pension Funds in May 2009 which commented on the impact which any retrospective abolition of upwards only rent reviews would have on property values. I should add that the decision to confine the prohibition on upwards only rent review clauses to future leases was informed solely by constitutional and legal considerations.
