Question 509: To ask the Minister for the Environment, Heritage and Local Government when he received confirmation of date of application and date of approval in respect of planning matters for a company (details supplied) in County Carlow arising from the pig dioxin investigation carried out by his Department; and if he will make a statement on the matter. Under planning legislation, the decision as to whether to grant a planning application, with or without conditions, is a matter for the relevant planning authority and An Bord Pleanála on appeal. In making decisions on planning applications, planning authorities and the Board must consider the proper planning and sustainable development of the area, having regard to the provisions of the development plan, any submissions or observations received, relevant Ministerial or Government policies, including any guidelines issued by the Department.

Under section 30 of the Planning and Development Act 2000, I am specifically precluded from exercising any power or control in relation to any particular case, with which a planning authority or An Bord Pleanála is or may be concerned. I am, however, a statutory consultee in relation to planning applications which impact on the built and natural heritage and in this regard, a copy of an application, reference 0987, for retention of variations from previous permissions granted for this site was received by my Department from Carlow County Council on 6 April 2009. My Department had no observations on the planning application, which I understand was granted by the Council on 30 September 2009. My Department has received no record of a notification from the Council of the permission being granted.
