Question 315: To ask the Minister for Justice, Equality and Law Reform when an application in respect of a person (details supplied) in County Westmeath for review of a decision, in respect of the refusal to grant them the appropriate rights pursuant to the EU Charter of Fundamental Rights, will be heard; if same will be expedited; and if he will make a statement on the matter. I am informed by the Immigration Division of my Department that the person concerned made an application for residence in the State based on his marriage to a British national on 30 January 2009. The person referred to by the Deputy was informed of the decision to refuse his application on 7 July 2009. A request by the applicant and his spouse for a review of this decision was received on 8 September 2009. All applications for review are dealt with in chronological order of date of receipt and the decision to refuse this application remains under review.
