Question 387: To ask the Minister for Justice, Equality and Law Reform further to Parliamentary Question No 1419 of 19 January 2010, the definition of acceptable evidence, that an EU national was exercising their EU rights here; and if he will make a statement on the matter. [5144/10]

I wish to advise the Deputy that as per my reply to PQ No. 586 of 19 January 2010 that the individual in question was advised by letter on 23rd December 2009 that their application was refused on the basis that the person concerned failed to provide sufficient evidence that the EU National spouse was exercising his EU Treaty Rights in this State.

The individual was advised that if they felt the Deciding Officer in this case had erred in fact and/or law then they were entitled to request a review of the decision and the details of how they could seek such a review were set out in the letter. I should advise that to date my Department has received no such request from the applicant. Should the applicant request a review it will then be a matter for the Review Officer to consider the application in further detail and at that stage they may indicate specific further documentation that may be required.
