I propose to take Questions Nos. 171 and 172 together.

I can advise the Deputy that the position as outlined in the reply given on 17 September last remains largely unchanged. As outlined at that time, following the successful appeal to the Supreme Court in this case, judgment was issued on 30th April 2009. The final step in the legal process is the granting of a final perfected Order by the Supreme Court which the Court asked the Minister to prepare. A draft Order has been prepared and is with the Office of the Chief State Solicitors Office for presentation to the Supreme Court. The Order, when perfected, will contain the definitive list of the parties to whom the report may be circulated. I am therefore not currently in a position to circulate this report until the Order has been perfected. Upon delivery of the perfected Order, I will ensure that the contents of the report is promptly brought to the attention of the parties specified in the Order.
