Question 151: To ask the Minister for Finance if the boards of State agencies under the aegis of his Department which are required to implement the new code practice for the governance of State bodies have formally adopted the code at a board meeting; if they have undertaken training to ensure proper implementation of the code; if they have put in place monitoring procedures to ensure proper compliance with the code; and if he will make a statement on the matter. I propose to take Questions Nos. 150 and 151 together.

The code of practice for the governance of State bodies applies to the following bodies under the aegis of my Department.

BodyComment
An Post National LotteryThe Company has advised that it is adopting the new Code though it has not been formally adopted at a Board meeting; that the question of training to ensure proper implementation of the Code will be considered; and that compliance with the Code will be monitored.
Financial Services OmbudsmanThe code of practice has been formally adopted and training has been undertaken to ensure proper implementation of the code and its implementation will be monitored.
Financial Services Ombudsman CouncilThe code of practice has been formally adopted and training has been undertaken to ensure proper implementation of the code and its implementation will be monitored.
National Treasury Management AgencyThe practicalities of the application of the Code to the NTMA and its associated bodies, which do not follow the general semi-state model in all respects, are being examined.
Anglo Irish BankThe code has not been separately scheduled to be adopted at an Anglo Board meeting. However, the Anglo Board's commitment is confirmed by its adoption of the Relationship Framework and the references to taking appropriate account of the code therein. Anglo Irish Bank is currently in the process of putting procedures in place to ensure that the requirements of the code as it applies to the Bank are adhered to. Monitoring of adherence to the procedures will be overseen by a Board committee

While within the current statutory provisions, the Central Bank and Financial Services Regulatory Authority are independent of the Minister for Finance in this area, I understand that the Board of the Central Bank and the Regulatory Authority have adopted codes of practice which reflect the document prepared by my Department.
