Question 193: To ask the Minister for Justice, Equality and Law Reform the reason a request for two passport-size photographs and a copy of current passport was issued to a person (details supplied) in County Kildare in connection with consideration of their case under section 3 of the Immigration Act 1999 as amended; and if he will make a statement on the matter. It is my Department's practice to seek to obtain the documentation referred to by the Deputy from persons whose cases are falling due for consideration under Section 3 of the Immigration Act 1999 (as amended). Such documentation is sought so that documentary evidence as to an individual's identity and nationality is to hand in advance of a decision being made. Where such documentation is submitted and a favourable decision is made, this can assist the subsequent registration process. The Deputy might wish to note that a favourable decision was made in the case of the person concerned.

The registration process applicable to non-national persons is founded on the provisions of Section 9 (2) of the Immigration Act 2004.
