Question 315: To ask the Minister for Justice, Equality and Law Reform the reason for the delay in the publication of the proposed capacity legislation in view of the commitment stating it will not ratify the Convention on the Rights of Persons with Disabilities until capacity legislation has been put in place; if a timeframe has been set for this proposed legislation; and if not, the reason for same. I propose to take Questions Nos. 295 and 315 together.

The Government Legislation Programme, published on 16 September 2009, indicates that the Mental Capacity Bill is expected to be published in early 2010.
