Question 177: To ask the Minister for Finance, further to Parliamentary Question No. 343 of 6 October 2009, if he is in possession of a property (details supplied) in County Cork; if so, the steps to be undertaken by the adjoining property owners who wish to acquire the freehold interest in the property. I refer to my reply to Parliamentary Question No. 33857/09 of 6 October 2009. In order to confirm that this land is vested in the Minister for Finance a formal application should be forwarded to the office of Public Works, in the first instance. The application will be referred to the Chief State Solicitor's Office who in order to assess the legal issues of the application will request all necessary information from the applicant/s. The Chief State Solicitor's office will then advise the Minister. Finally, the Minister having regard to the legalities and merits of the application will then at his discretion decide whether to waive his interest, if it exists, or not.
