Question 307: To ask the Minister for Finance further to Parliamentary Question No. 128 of 13 October 2009, if he make available all reports on the European Anti-Fraud Office database that are available to his Department regarding illicit cigarette trade; and if he will make a statement on the matter. I am informed by the Revenue Commissioners that the legal basis for communications between the European Anti-Fraud Office (OLAF) and the competent authorities of the Member States is Council Regulation (EC) No. 515/97 on Mutual Assistance in Customs Matters.

All such communications, including the reports referred to by the Deputy, are subject to a strict confidentiality clause under Article 45 of this Regulation. In the circumstances, it is not possible to make such reports available to the Deputy.
