Question 618: To ask the Minister for Justice, Equality and Law Reform when he will introduce legislation to amend section 13 of the Criminal Law (Insanity) Act 2006 to ensure that patients in the Central Mental Hospital are discharged when they are fit to be discharged and that their rights to liberty are not being denied; and if he will make a statement on the matter. A bill to amend section 13 of the Criminal Law (Insanity) Act 2006 is currently being drafted in the Office of the Parliamentary Counsel. The Bill will provide that enforceable conditions can be applied where a person detained in the Central Mental Hospital in accordance with the Criminal Law (Insanity) Act 2006 is granted conditional release by the Mental Health (Criminal Law) Review Board. It is expected that drafting will be completed this Autumn with a view to publication and progress through the Houses of the Oireachtas shortly thereafter.
