Question 332: To ask the Minister for Health and Children if it is the case that preconditions for registration previously imposed on individual nursing homes by the Health Service Executive will remain in place until they have been inspected by the Health Information and Quality Authority; and if she will make a statement on the matter. Yes, Section 104 of the Health Act, 2007 provides that certificates given under the Health (Nursing Homes) Act, 1990 continue to have effect as if given under the Health Act, 2007. The Deputy will be aware that the process of the registration and inspection of nursing homes under the Health Act, 2007 (Registration of Designated Centres for Older People) Regulations commenced on July 1st. A transitional provision in the 2007 Act allows existing designated centres carry on their business for a period not exceeding 3 years, or such shorter period as the Chief Inspector for Social Services may determine.
