Question 277: To ask the Minister for Justice, Equality and Law Reform further to section 70 of the Immigration, Residence and Protection Bill 2008, if he will amend the provision allowing an immigration officer, when it is not practicable to issue a protection application entry permit on arrival, to arrest and detain an applicant for the purpose of issuing a protection application; and if he will make a statement on the matter. As was indicated at Dail Committee Stage by my colleague, Minister of State John Moloney, T.D., the provision referred to by the Deputy is under consideration in my Department in consultation with the Office of the Attorney General. The matter is one that has, in addition to the debate at Committee Stage, been brought to my attention by the Irish Human Rights Commission and indeed by the Deputy himself. I will inform the House of my response, as soon as possible, in the context of my proposals for amendments to the Bill at Report Stage.
