Question 83: To ask the Minister for Transport if he will clarify the position in relation to the continued use of the Dublin Port tunnel by the 41X service run by Dublin Bus; if he will withdraw permission for this service to use the tunnel; and if he will make a statement on the matter. As part of the settlement of High Court proceedings brought by the operators of the Swords Express bus service, my Department undertook to carry out an investigation under Section (25) (2) of the Transport Act 1958 in relation to the decision to note the re-routing through the Port Tunnel of the 41X service operated by Dublin Bus.

That investigation has been completed and copies were sent to both Swords Express and Dublin Bus who were invited to make submissions as to whether the Minister should grant consent under section 25 (1) of the Transport Act 1958 Act to Dublin Bus to continue to operate the 41X service on its current route. Both parties have made submissions, which are currently being considered by my Department.
