Question 185: To ask the Minister for Justice, Equality and Law Reform if his attention has been drawn to the fact that management companies are refusing to provide the full range of services to apartment owners in view of the fact that so many of the owners are unemployed and cannot pay the fees; if he will ensure that the regulation of management companies Bill is introduced and passed without delay; and if he will make a statement on the matter. The position is that legislation to address the Law Reform Commission's recommendations on multi-unit developments is in the course of being drafted by the Parliamentary Counsel as a matter of priority. The intention is to publish the Bill in this Session.

The principal focus of the new Bill will be on ensuring good governance of property management companies and similar bodies which comprise the owners of units within multi-unit developments and which exercise management functions in relation to such developments. It will also include provisions for the resolution of disputes arising in relation to such matters. The range of services to be provided, and the extent of such provision, are matters to be decided by the property management company based on the agreement of the unit owners who make up the company.
