Question 160: To ask the Tánaiste and Minister for Enterprise, Trade and Employment if she will confirm the stated policy of the Employment Appeals Tribunal in relation to High Court judicial reviews taken against it in view of the opinion that the EAT is adopting a policy of not contesting judicial reviews taken against it. The Employment Appeals Tribunal is an independent body under the aegis of the Department. As an independent body, I have no role in relation to the day-to-day operation of the Tribunal.
I understand that each judicial review proceedings in which the Tribunal is named is considered on the basis of the notice of motion before the Court. All aspects of the motion including previous similar proceedings are considered before a decision is reached whether or not to take part in the judicial review proceedings.
