Following an inspection, the person named was notified on 22 September 2008 of a penalty for non-compliance with her obligations under REPS. This penalty was not appealed and a letter issued on 29 October 2008 informing her that the penalty in the amount of €850.67 would be deducted from her next payment. The deduction was made from a payment which issued on 1 December 2008.

REPS 4 is a measure under the current Rural Development Programme 2007-13 and is subject to EU Regulations which require detailed administrative checks on all applications to be completed before the first payments issue. The first payments for 2008 REPS 4 applications issued in the last week of January to those whose applications required no correction following the administrative checks. Further payments continue to be made as applications are cleared. Queries have arisen during the administrative checks on the plan of the person named and it is currently under further examination.

The arrangements for payment of grants under the Farm Waste Management Scheme on a phased basis have been confirmed with 40 per cent being paid this year as claims are approved. A further 40 per cent will be paid in early January 2010 and the remaining 20 per cent in January 2011. Payment of the initial 40 per cent to farmers will be made as expeditiously as possible.

As outlined in replies to two previous questions from the Deputy, an application was received on the 15 May 2008 requesting the transfer of 15.02 standard entitlements to the person named from his father by way of gift. Having resolved the initial difficulty whereby the person named did not hold a herd-number, the person named and his father were requested to complete a Declaration of Undertaking form. In addition, the signatures of both the person named and his father were absent from the Transfer Application form and the signature of the person named on the Deed of Transfer had not been witnessed. Copies of these documents were returned to the person named for completion.

In his correspondence of the 21 January 2009, the person named returned the copy of the Application Form with relevant signatures added as well as the completed Declaration of Undertaking Form. A representative of Teagasc witnessed the signatures on the Application Form. However the copy of the Deed of Transfer, upon which the signature of the person named should be witnessed, was not returned. A further letter issued to the person named on the 13 February 2009 requesting the return of the witnessed Deed of Transfer. Upon receipt of this latter document, the application will be processed without delay.
