Question 88: To ask the Minister for Finance if he will confirm whether a group (details supplied) has met all requirements of the Financial Regulator to provide monthly data on capital adequacy for the past year, and for the months of November 2008, December 2008 and January 2009 in particular; and if he will make a statement on the matter. In my role as the Minister for Finance I have responsibility for the development of the legal framework governing financial regulation. The day-to-day responsibility for the supervision of financial institutions is a matter for the Financial Regulator, which is statutorily independent in the exercise of its regulatory functions. The Financial Regulator is also obliged to treat as confidential the information it holds on regulated entities. In relation to the specific matter raised by the Deputy, the Financial Regulator has informed me that under the provisions of Section 33AK of the Central Bank and Financial Services Authority of Ireland Act, 2003 (which deals with disclosure of information) it is unable to provide information in relation to individual firms.
