Question 346: To ask the Minister for Social and Family Affairs if a review will be undertaken in the case of an application for supplementary welfare allowance or rent supplement in the case of a person (details supplied) in County Kildare; when the appeal will be heard in this regard; if she will confirm that interim payment will be in place while the appeal is pending; and if she will make a statement on the matter. All applicants regardless of nationality, from 1 May 2004, are required to be habitually resident in the State in order to qualify for supplementary welfare allowance. The person concerned was refused supplementary welfare allowance and rent supplement on the grounds that he is not habitually resident in the State. The designated Appeals Office of the Health Service Executive has advised that it has received an appeal from the person concerned. The appeal will be processed as quickly as possible once all appropriate information is available to that office, including additional information requested from the community welfare officer. The Executive has advised that, as an exceptional measure, a payment issued to the person concerned on 3 December 2008.
